Important Notice: By using the SpeakMeta App (defined below), you accept the following terms and conditions. If you do not agree to the terms and conditions set forth in this article, please do not use the SpeakMeta App.
1. ACCEPTANCE DEADLINE
The following documents include the terms and conditions governing your ("you" or "user") access to and use of SpeakMeta App ("we" or "we") proprietary mobile applications and websites (referred to as SpeakMeta App) and its content, features, and services (collectively referred to as "SpeakMeta App"). These "Terms" constitute a binding agreement between you and SpeakMeta App, and by continuing to use SpeakMeta App (in whole or in part) in any way, you agree to abide by and be bound by these Terms. If you do not understand and/or agree to these terms, you should immediately exit the SpeakMeta App and stop using the SpeakMeta App.
We can unilaterally change or add these terms at any time. If there are significant changes, we will notify you via email, text message, or prominent notification on the SpeakMeta App. You should regularly check the SpeakMeta App and view changes to the terms. By continuing to use the SpeakMeta App after such modifications, you agree to be bound by such modifications.
2. OUR SERVICES
SpeakMeta provides an intelligent spoken conversation application that can meet the needs of multi-role dialogue and practice speaking in multiple scenarios. We reserve the right to change or discontinue the Service (or any component) at any time, temporarily or permanently, with or without prior notice. You acknowledge that SpeakMeta is not responsible for any modification, suspension or discontinuance of the Service by you or any third party.
3. LICENSE
According to the terms and conditions set forth in this Agreement, SpeakMeta App hereby grants to you, and you accept, a personal, non exclusive, non transferable, non sublicensable, revocable, limited license to access and use SpeakMeta App for non-commercial purposes only in accordance with these terms. The SpeakMeta App may terminate its license at any time.
4. MEMBERSHIP AND SUBSCRIPTION
4.1 Becoming a Member
To access and use the SpeakMeta service, you must register and create an account. By registering, you agree to provide accurate, current, and complete personal information as requested in the registration form. Your registration information and certain other personal data are subject to our privacy policy.
4.2 Once You Become a Member
You are responsible for maintaining the confidentiality of your password and account details, and for all activities that occur under your account. You agree to (a) promptly notify SpeakMeta of any unauthorized access to your password or account, or any security breaches, and (b) log out of your account after each use of the service. SpeakMeta is not liable for any loss or damage caused by your failure to comply with these obligations.
4.3 Your Membership
As a SpeakMeta member, you will gain access to exclusive content, features, and functionalities that are unavailable to non-members. By becoming a member, you consent to receiving occasional promotional offers, marketing materials, surveys, and other communications related to the service. You may easily opt-out of these emails by following the provided instructions. SpeakMeta membership and subscriptions are non-transferable, and cannot be sold, exchanged, or transferred in any manner.
5. PURCHASES
The SpeakMeta App offers certain enhanced features or packages that you may purchase ("In-App Purchases"). Descriptions of the features related to in-app purchases are available through the SpeakMeta App’s mobile app and website.
When you make an in-app purchase, you acknowledge and agree that all billing and transaction processes are handled by the App Store provider from which you downloaded the SpeakMeta App (the "App Provider"), including but not limited to the Apple App Store, Google Play.
All payments are final, non-refundable, and non-transferable.
SpeakMeta App reserves the right to modify its in-app purchase pricing terms at any time. SpeakMeta App will notify you of such changes before they take effect. Pricing changes will not be applied retroactively and will only apply to in-app purchases made after the pricing change has been communicated to you. If you do not agree with the updated pricing terms, you may choose not to make in-app purchases.
6. FREE TRIALS
We may, from time to time, offer trials of paid features at no charge or at a reduced rate for a specific period. SpeakMeta App reserves the absolute discretion to determine your eligibility for the trial and may, at its sole discretion, withdraw or modify the trial offer at any time without notice and without liability.
7. SUBSCRIPTION PERIOD
Certain services or parts of the services may only be accessible through a paid subscription. You will be billed on a recurring basis (e.g., monthly, or annually), depending on the subscription plan you selected at the time of purchase.
At the end of each subscription period, your subscription will automatically renew under the same terms unless you cancel or the company terminates the subscription.
8. SUBSCRIPTION CANCELLATION
You can cancel the renewal of your subscription through your account settings page or by contacting the company. You will not be refunded for any fees paid during the current subscription period. However, you will still have access to the service until the end of the current subscription period.
If your subscription was made through an in-app purchase, you can cancel the renewal through the app store from which you purchased the subscription.
9. REFUNDS
Except where required by law, subscription fees are non-refundable.
Certain subscription refund requests may be considered on a case-by-case basis, and the company reserves the right to approve or deny any such requests at its sole discretion.
If your subscription was made through an in-app purchase, the refund policy of the app store will apply. If you wish to request a refund, you can contact the app store directly for assistance.
10. WARRANTIES AND DISCLAIMERS
You expressly acknowledge and agree that the use of the Services and the Application is at your own risk, and you assume full responsibility for any risks associated with the satisfactory quality, performance, accuracy, and effort. The Services and the Application are provided "as is," without any warranties of any kind. SpeakMeta does not warrant that the use of the Services will be uninterrupted, error-free, or meet your specific requirements. SpeakMeta makes no express or implied representations or warranties regarding the Application, the Services, content, or their use, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, compatibility, response, non-infringement, completeness, or lack of negligence.
The Application is based on artificial intelligence and machine learning, meaning the Application responds to your input and engages in conversation with you. However, the output of the Application, especially during interactions or repeated discussions, heavily relies on your input. The Application prohibits the input of explicit, obscene, offensive, abusive, racist, hateful, or otherwise inappropriate content. Any responses generated by the Application based on such content (or any other content you input) are not endorsed by SpeakMeta, and you are fully responsible and liable for those inputs. SpeakMeta assumes no responsibility for the content of such responses.
SpeakMeta does not provide medical or psychological services and disclaims any liability in this regard. If you believe you are experiencing a medical or mental health emergency, please contact emergency services or visit the nearest open clinic or emergency room.
If you are considering suicide or feel you may harm yourself or others, you must immediately cease using the Services, call emergency services, or notify the appropriate law enforcement or emergency medical personnel.
11. LIMITATION OF LIABILITY
Under no circumstances shall SpeakMeta, its shareholders, directors, officers, or employees be liable for any personal injury, special, incidental, punitive, indirect, or consequential damages, including but not limited to loss of data, loss of goodwill, lost profits, loss of deposits, loss of business information, or any other economic loss arising from or related to these Terms and Conditions, the Services, the Application, or the use or inability to use the Services or the Application, regardless of the theory of liability, even if SpeakMeta has been advised of the possibility of such damages. In no event shall the liability of SpeakMeta and its shareholders, directors, officers, or employees under these Terms and Conditions or in connection with your use of the Services or the Application exceed the amount you actually paid for the Services, if any, in connection with the claim or cause of action.
12. INDEMNIFICATION
Upon first request, you agree to defend, indemnify, and hold harmless SpeakMeta, its shareholders, directors, officers, and employees from any claims, liabilities, costs, losses, damages, and expenses (including reasonable legal fees) arising from and/or caused by: (i) your use, misuse, and/or activities related to the Application and/or the Services; (ii) your violation of any Terms and Conditions or any third-party rights, including but not limited to privacy rights, copyright, or any other intellectual property rights of a third party; (iii) any damage you may cause to any third party in connection with the Application, whether direct, indirect, special, or consequential. Without limiting the foregoing, we reserve the right to defend and control any matter that you are required to indemnify us for, at our own cost, but this does not relieve you from your indemnity obligation under this agreement, and in such cases, you will fully cooperate with us in raising any available defenses. You agree not to settle any matter involving your indemnity without our prior written consent.
13. CHANGES TO THE SERVICE AGREEMENT
